1. Our Commitment to Privacy

Your privacy is important to us. This privacy policy is intended to inform you (“you”, collectively “Consumers”) about HelpfulCrowd Limited (“HelpfulCrowd”, “we”, “us”, or “our”) collection, use, and disclosure of information that we receive through the services that we provide on our Clients websites (the “HelpfulCrowd Network”), through our corporate website, helpfulcrowd.com (“Website”), and through the business applications offered on the Website, app.helpfulcrowd.com (“App”) (collectively, the “Sites”). It also describes your choices regarding use, access and correction of your personal information.

2. General

By visiting our Sites, or using our Services, you expressly consent that any information that we collect from or about you directly, including Personal Information, anonymous information, and aggregate information (collectively, “Information”), will be handled as described in this Privacy Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. Our Terms of Service are incorporated by reference into this Privacy Policy.
We define “Personal Information” to mean personally identifiable information about an individual, such as a name, address, e-mail address, phone number, or other identifier that permits direct or indirect identification of a specific individual, or as otherwise defined by applicable privacy and data security.

We define “Services” to mean any paid or free services provided to Clients by HelpfulCrowd via the App.
If you do not agree with this policy, do not access or use our Services or interact with any other aspect of our business.

3. Information We Collect Through the HelpfulCrowd Network

User-Generated Content. As part of our Services to our Clients, we provide Consumers the ability to submit reviews (with comments in text together with photos/video attachments) and rate goods, products, services and businesses, or ask questions (collectively, “User-Generated Content”), for websites within the HelpfulCrowd Network.

You should be aware that any information you provide as User-Generated Content, solicited or unsolicited, will be published on a publicly facing website and will be read, collected, and used by the anyone including HelpfulCrowd, its subsidiaries, other consumers, vendors and Clients. Therefore, please do not submit any User- Generated Content (unless specifically requested to complete) that you do not want to share with the general public, including personally identifiable information, such as your full name, e-mail address or financial information.

HelpfulCrowd will never publicly display your full name or e-mail address and has implemented safeguards to prevent e-mail addresses being accidentally displayed publicly.

User-Generated Content may be collected either on an unsolicited or solicited basis. Unsolicited User-Generated Content is submitted voluntarily by you on websites within the HelpfulCrowd Network. Solicited User-Generated Content is initiated by our client, generally as a result of a sale or transaction you have completed. During the course of using our Clients services, you may order or purchase goods, products or services and as a result submit information, such as but not limited to, your name, e-mail address, items purchased and other data (collectively, “Sales Order Info”). Some Sales Order Info may be shared with us to request User- Generated Content on their behalf, usually in the form of an e-mail.

4.1 The Information We Collect

Information We Collect Directly from You. We may collect Information directly from you. For example, we may collect Information such as your full name, e- mail address, User-Generated Content and social network user name.

Information We Collect from Third Parties. Clients may share Sales Order Info with us. For example, e-mail address, full name and IP address. We may also give you the opportunity, in order to enhance your user experience, to share your User-Generated Content with friends, colleagues, etc. in other platforms (such as social networks). We therefore may collect other Information, such as profile pictures or personal network connections, from platforms that you share HelpfulCrowd User- Generated Content or interact with.

Information Automatically Collected About You. We also automatically collect Information through your use of our Site and Services using cookies and other technologies. This Information may include, without limitation, information about your operating system, geolocation, settings and system configurations, IP address, device model, device ID and other unique device identifiers, the webpages you access within our Site, the website that led you to our Site, the website to which you go after leaving our Site, the dates and times you access our Site, and web log data.

4.2 How We Use Your Information

HelpfulCrowd uses User-Generated Content for providing the Services to our Clients, marketing research, new product development, to personalise or improve our Services, to detect fraudulent activities and for analytical purposes.

In addition, you agree that we may use your Information, including Personal Information, for the following purposes:
i) To personalise your experience (your Information helps us to better respond to your individual needs). To analyse and improve our Services (we continually strive to improve our Sites and Services offerings based on the Information and feedback we receive from you).

ii) To process transactions and orders you make through or in connection with the Sites and Services and registration thereto. Your Information, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.

iii) To administer a contest, promotion, survey or other Sites and Services feature.

iv) To comply with applicable legal obligations, including responding to informal requests for information from governmental authorities, and to prevent activity we determine to be potentially illegal.

v) For the enforcement of this Privacy Policy and/or our Terms of Service or any other purpose referenced herein or therein, including to protect the rights of our customers, their end users, and the general public.

We may also use Information that has been de-identified and/or aggregated for purposes not otherwise listed above.

4.3 Data Collection Technologies

Passive Collection. As is true of most websites and mobile apps, we gather certain information automatically. Our technologies may collect the IP address of your computer, the pages you visit within the HelpfulCrowd Network, the date and time of your visit, browser type and version, and other click-stream data (collectively “Analytics and Tracking Data”). We use the Analytics and Tracking Data to operate the Sites and Services, enable the submission of User-Generated Content and to enable anonymous analytics and measurement reporting.

Types of Technologies on the HelpfulCrowd Network. We and our partners use cookies or similar technologies to collect information from Consumers on the HelpfulCrowd Network. We do so to analyse trends, administer and track users’ movements around the HelpfulCrowd Network, and to gather demographic info about our user base as a whole.

Cookies. We, or our service providers use cookies to track visitor activity, to personalise content, improve services, provide customer support and for analytics.
A cookie is a text file that a website transfers to your computer’s hard drive for record-keeping purposes. We or our service providers may use cookies to track user

activities on our Sites, such as providing customer support services or to analyse user behaviour our Sites.

We or our service providers may use clear GIFs (also known as web beacons, web bugs or pixel tags), in connection with our Sites and Services to track the activities of visitors to our Sites, help us manage content, and compile statistics about usage of our Sites and Services. We or our service providers may also use clear GIFs in HTML e-mails to our users, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Do Not Track. Our Sites and Services may not respond to Do Not Track signals and we may track your activities once you leave our Sites. You may disable certain tracking as discussed in this section (e.g., by disabling cookies).

Third-Party Analytics. We use service providers, such as Google Analytics, to evaluate the use of our Site and Services. We, or our service providers use automated devices and applications to evaluate use of our Site and Services. We or our service providers use these tools to help us improve our Sites and Services, performance, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons to perform their services.

Cross Device Collection. Your information may be combined across all the devices and browsers with which you access the HelpfulCrowd network.

Our Clients may use Data Collection Technologies on their sites. Your interactions with these sites are governed by the privacy policy of our Clients sites.

5. Information We Collect Through the Website

Our Website offers publicly accessible blogs. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Therefore, please do not include any Personal Information in any blog postings or comments that may appear on the Website. To request removal of your personal information from our blog or community forum, contact us at hello@helpfulcrowd.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

With your prior consent, we may display your personal testimonial or success story along with your name on the Website. If you wish to update or delete your testimonial, you can contact us at hello@helpfulcrowd.com.

Information We Collect from Third Parties. We may be provided information such as your name and location from our service providers. We may also collect your social network username and profile picture if you share share HelpfulCrowd User-Generated Content or interact with your social channel.

We provide User-Generated Content Services to Clients and may use your information for marketing, marketing research, new product development, to personalise or improve our Services, to detect fraudulent activities and for analytical purposes.

In addition, you agree that we may use your Information, including Personal Information, for the following purposes: i) To personalise your experience (your Information helps us to better respond to your individual needs).

ii) To analyse and improve our Services (we continually strive to improve our Sites offerings based on the Information and feedback we receive from you). iii) To improve customer service (your Information helps us to more effectively respond to your customer service requests and support needs).
iv) To send periodic e-mails, updates, newsletters, and special offers, and for other marketing or advertising purposes.
v) If you decide to opt-in to our mailing list, you will receive e-mails that may include company news, updates, related product or service information, etc. vi) To administer a contest, promotion, survey or other Sites and Services feature.

6. Information We Collect Through the APP

6.1 The Information We Collect

Information We Collect Directly from You.
Account and Profile Information: We may collect Information directly from you when you register for an account, create or modify your profile, set preferences, sign-up for or make purchases through the Services. For example, you provide your contact information and, in some cases, billing information when you subscribed to plans. You also have the option of adding a profile photo and other details to your profile information to be displayed in our Services. We keep track of your preferences when you select settings within the Services. If you signed up for our Services by e-mail, then you will also have supplied a password which is subsequently stored encrypted.

Information you provide through our support channels: The Services also include customer support, where you may choose to submit information regarding a problem you are experiencing with a Service. Whether you designate yourself as a technical contact, open a support ticket, speak to one of our representatives directly or otherwise engage with our support team, you will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.

Payment Information: We collect certain payment and billing information when you register for certain paid Services. For example, you might provide payment information, such as payment card details, which we collect via a PCI compliant secure payment Sub-processor service.

Information We Collect from Third Parties.
Other services you link to your account: We receive information about you when you or your administrator install the App or enable third-party apps with our Services. For example, if you create an account or log into the App using your eCommerce credentials, we receive your name, email address and Store ID in order to authenticate you. You or your administrator may also integrate our Services with other services you use, such as to allow you to access, store, share and edit certain content from a third-party through our Services. For example, you may authorise our App to sync historic sales orders so that you can easily send out invitations to contribute User-Generated Content. The information we receive when you link or integrate our Services with a third-party service depends on the settings, permissions and privacy policy controlled by that third-party service and authorised by you. You should always check the privacy settings and notices in these third- party services to understand what data may be disclosed to us or shared with our Services.

Other partners: We may receive information about you and your activities on and off the Services from third-party partners, such as social channels, advertising and market research partners who provide us with information about your interest in, and engagement with, our Services and online advertisements.

7. Legal Basis for Processing (for EEA users):

If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal basis for doing so under applicable EU laws. The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where:

i) We need it to provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services;

ii) It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Services and to protect our legal rights and interests;

iii) You give us consent to do so for a specific purpose; or

iv) We need to process your data to comply with a legal obligation.
If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party (e.g. your employer) have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

8. Opting Out of Marketing Communications

If you receive Marketing communications from HelpfulCrowd and would no longer like to be contacted, please use the “unsubscribe” functionality in the e-mail. If you receive marketing communications from one of our Clients and would no longer like to be contacted by them, please contact that Client directly.

9. Right to Access, Correct, Update or Delete Your Information

HelpfulCrowd has no direct relationship with the Consumers whose personal data it processes on behalf of our Clients. In this capacity, we are a Data Processor. If you would like to access, correct, amend, or delete your personal information or Solicited User-Generated Content, please contact that Client directly. If the Client requests HelpfulCrowd to action your request, we will respond to their request within a reasonable timeframe.

If you would like to access, correct, amend or delete any of your Personal Information collected or held directly by HelpfulCrowd, please login to the App and contact us via the messenger service or e-mail us at hello@helpfulcrowd.com. We will respond to such requests within a reasonable timeframe.

10. Disclosure Of Your Information to Third Parties

We will share your personal information with third parties only in the ways that are described in this privacy policy, unless we otherwise obtain your consent. We do not sell your name, phone number, e-mail or mail address to third parties.

Clients. Personal information may be made available to our Clients in certain circumstances. For example, if you submit a question about a product to a website on the HelpfulCrowd Network, the question and your e-mail address will be shared with the Client that controls the website that the question was submitted to, the product manufacturer, or retailer to help answer the question. We disclose aggregated and anonymized data, and non-personal information derived from that, to our Clients in order for them to display advertisements and personalised content to Consumers.

With your consent: We share information about you with third parties when you give us consent to do so. For example, we often display personal testimonials of satisfied customers on our public websites. With your consent, we may post your name alongside the testimonial.

Sub-Processors. We work with trusted third-party service providers (“Sub-processors”) to provide website and application development, hosting, maintenance, backup, storage, virtual infrastructure, payment processing, analysis and other services for us, which may require them to access or use information about you. If a service provider needs to access information about you to perform services on our behalf, they do so under instruction from us and are authorized to use your personal information only as necessary to provide these services to us.

HelpfulCrowd Partners. We work with third parties who provide consulting, sales, support and technical services to deliver and implement customer solutions around the Services. We may share your information with these third parties in connection with their services, such as to assist with billing and collections, to provide localised support, to provide development and customisations.

Third-party Apps. You, your administrator or other Service users may choose to add new functionality or change the behavior of the Services by enabling third party apps within our App. Doing so may give third-party apps access to your account and information about you like your name and email address, and any content you choose to use in connection with those apps. If you are an administrator or contact listed on an account, we share your details with the third-party app provider upon installation. Third-party app policies and procedures are not controlled by us, and this privacy policy does not cover how third-party apps use your information. We encourage you to review the privacy policies of third parties before connecting to or using their applications or services to learn more about their privacy and information handling practices. If you object to information about you being shared with these third parties, please disable the app.

Third-party Widgets. Our Services include social media features, such as the “Facebook” or “Twitter” buttons. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our website. Your interactions with these features will be governed by the privacy policy of the company providing them.

Compliance with Enforcement Requests and Applicable Laws; Enforcement of Our Rights. We will also disclose any information we collect, use or receive: if required or permitted by law, such as to comply with a subpoena, or similar legal process; and, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, meet national security requirements, or respond to a government request.

Business transfers. Finally, any information in our possession or control will be disclosed in connection with any merger, acquisition, debt financing, sale of company assets, or other business transaction in which data could be transferred to third parties as one of our business assets. You will be notified via e-mail and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have.

11. Processing and Transfer of Your Information

Your Information will be collected, processed, stored and used by us, and if/when applicable may be passed to and processed by our Sub-processors, subsidiaries and/or affiliated companies. Information contributed by or collected from users may be stored and processed in any country in which we or our affiliates, subsidiaries or Sub-processors maintain facilities. By using the Site and Services, you acknowledge and agree that you may be transferring your Information, including Personal Information, outside of the country in which you have contributed it, and that you consent to any such transfer of information outside of your country to a country that may not offer the same level of protection for Information as the country in which you reside. Personal Information that is transferred outside the EU and Switzerland is subject to EU-U.S. and Swiss-U.S. Privacy Shield Frameworks.

12. Security

The security of your personal information is important to us. We follow generally accepted standards to protect personal information and use data security measures that are designed to protect the information we collect from unauthorized access, disclosure, alteration, or destruction. Please be aware, however, that no data security measures can be guaranteed to be completely effective. Consequently, we cannot ensure or warrant the security of any information.

Furthermore, in order to protect your privacy we urge you:
i) use strong, hard to guess passwords;
ii) to protect against unauthorised access to your use of the Sites;
iii) to ensure no one else uses the Sites while the user’s machine is “logged on” to the Sites; iv) to log off or exit from the Sites when not using it; and
v) where relevant, to keep your password or other access information secret.

13. Period We Keep Your Personal Information For

We will retain your Personal Information only as long as is necessary for the purposes to which you consent under our terms and conditions and this Privacy Policy, or as is required by applicable law, and then we will delete it.
You may close your account by contacting us at hello@helpfulcrowd.com. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.

14. Children

The Services are not directed to individuals under 16. We do not knowingly collect personal information from children under 16. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact our support services.

15. Other Information

The Website includes links to other websites whose privacy practices may differ from those of HelpfulCrowd. If you submit personal information to any of those sites, their privacy statements govern your information. We encourage you to carefully read the privacy statement of any website you visit.

16. Updates to this Policy

We may update this policy from time to time to reflect changes to our information practices. When we do, we will also revise the “last updated” date at the beginning of the policy.
